Yes, he was an idiot. The Tesla should have braked with the initial hit. Tesla will have deeper pockets for a lawsuit, but their software isn’t all it’s cracked up to be. It happened maybe 12 miles from where I live. I doubt it will get national coverage. It won’t even get posted on Reddit because the mods remove everything negative. You can like a car but not drink the Elon Kool-Aid.
