Top of the wear indicator is the requirement to CPO a off-lease car, not lease return. If you pull up the CPO checklist, you will see that requirement there.

Lease return is just simple 4/32nd tread depth at the thinnest tread.

Either dealer is stupid or they are trying to get out of paying new tires to CPO the car to their inventory.
