Ah, but unlike you I can't write a masterpiece of a sentence like this:

General consensus based on my lay research is that if you do engine coding, you are SOL when it come to warranty. But, if you are coding your mirrors to fold with lock, door handle lights to come on in reverse, splash screen to show a Christmas greeting, fog lights to turn on in reverse......things that the car is designed to do for other markets, then you have a defensible position on warranty issues. Turning off safety features (warnings, bells, disclaimers, video lock in motion) will likely get you in hot water with your insurance company if there is a serious incident as even some of those attributes are unlocked for some markets; you don't want to sell your car if you have coded away warnings.
Even the ACC in F series has a coding selection (not re writing code) to reduce the minimum distance between you and the car in front, and settings to unlock WB radio, recognize blind spot below 35mph.....none of these risk warranty damage. Change the power management settings or alter their mapping and they will know, even if you undo it.

So,
dvdinmotion is simply making features available that were locked from the factory or during importation. Do you honestly think BMW will give a shit if you're charging at 75% or 6% after it's already been imported? Whenever they see my mirrors fold in on my M3 via my key, they're like "Oh, cool." not "OMG VOIDED!!" In order to void a warranty, you have to prove that XYZ actions caused ZYX failures. This engine isn't running at higher RPM's or anything, it's just charging at a different interval. I think you're just fine man. |

The issue, as I see it, is that BMW sold the car with certain specs, and is getting certain credits for it operating that way from the US Federal Government. The feds, should they find out, could be quite annoyed, and not knowing the exact wording of the agreement, BMW may be required to monitor that functionality, and report the status. This falls into the similar category of modifying emissions control...any of those are cause for the state failing it on inspection, and if done by a company, a significant fine. Now, the likelihood of that happening is small, but it is not totally absent. Should you actually live in one of the CARB controlled states, the state could be quite annoyed as well.

The freedom of America:- not. You guys talk about a free country what a joke. I'm finished with reading and gone off this site for good. America is a place to visit and have friends but to live full time and be involved with your crazy federal laws no way.

First of all, almost no one is suing under 15 USC 2301, at least not in federal court because the damage claim has to exceed $50,000. If you live in a state that doesn't give a rat's ass about consumer protections you can still file an MM suit in state court. In the states I care about, CA, OR, and WA, the state laws are much stronger than 15 USC 2301 so I don't really care what the dealership thinks, or what BMWNA thinks, or what you think, since I'm on that topic. I already know what you think. You think I'm an idiot because I'm not an attorney. You think only attorneys are capable of reading or citing case law. You are welcome to your thoughts, Scooter. But, here's something else for you to think about. I bought a BEV last Thanksgiving and I don't care for the range or the way that the Adaptive Cruise Control operates. I claimed that when the ACC malfunctioned, which the owner's manual says it will do from time to time, that is was a warrantable defect. I took it to the dealership and demanded a fix. There isn't one. I sent a letter to BMWNA referencing ORS (you're an attorney so I'm sure you can figure out what ORS means) 646A.400 and demanded a fix or, in the alternative, a lawsuit. They didn't fix the car. I didn't file suit. I didn't have to because they bought it back for every cent I paid for it. And I mean every cent, license fees, dealer doc fees, all of it. I might buy a REx with the refund. After all, if I don't like it I can always make BMWNA buy it off of me anytime within 2 years or 24000 miles. It's a BMW, it will have warrantable issues. You can curse me for using my state's Lemon Law to exploit BMW but you'd be a complete hypocrite if you did. Then again, you're an attorney so I'm guessing you're used to that sort of thing.

Well these are minor issues compared to mine - when I bought my I8, everything I read or watched showed the car obtaining 20-25 mile range, its even published in the manual and the Tech Specs on the BMW site.
Well the car only gets 10-12 miles - its not just me, every car in the world is getting similar mileage. While I know the intent for the battery is for launch reasons, there are many of us who would like to drive or published 20-25 miles emission free and we can't. Now I see BMW changed both the specs and mileage after the EPA rated the car at 14 miles range. Where does that leave me? I live 9-10 miles from town, its a flat road 45 mph limit, we bought the car with the intentions of drive to town and back each morning and we can't! What are my options? Thanks |

Didn't you test drive it before buying one? I noticed in both my test drives that the electric range was 16 miles at most, and less if not driven economically. It doesn't bother me, as I'd rather not have the weight of a bigger battery in my i8. |

Temperature affects EV range...wait until summer, you might be surprised. Course, on an i8, most people will likely drive it at full tilt...that isn't how the EPA testing is done, so your results WILL differ.

To the guy saying he was told by BMW that the REX will now turn on at 12% soon with a update this spring . This is funny to me , tell your SA it already does from the factory . There is a 6 and 12% values today as well as the REX hold .
They must be running it by CARB to keep their carb credits . It is shame they put our safety at risk for the tree huggers . I am glad I do not live in a CARB state . |
