I8 had been in service department for 2 weeks can i get compensated?

I have had the i8 for 20 months and this is now the 2nd time it has been getting serviced for 2+ weeks.

Both times I got the ‘Drive train malfunction’ as well as the ‘regenerative breaking disabled’ notifications.

Last year they took 2 weeks to give it back to me and i was in a 3 series loaner and now again they gave me a 3 series loaner and it has now been exactlt 14 days.

My service advisor said last week they were waiting on backordered parts from Germany. This is a bit ridiculous to happen twice in a year and change. I am paying $1,460 a month for the lease and am driving a 3 series loaner.

Last year bmw rep said unfortunetly they cannot compensate me for this but now this happened again and its bullshit. I am paying $1,460 while having a 3 series for half the month already.

Is there anyway to get BMW to give some kind of compensation?

Might be less painful if they gave you a more upscale loaner...

What ^ said. Push for it (7 series minimum or any M car would be fair IMO)

Always good to throw around the term "lawyer"

From personal experience (mind you I've never sued anyone) it always seems to make things right sooner than later.

California's Lemon Law establishes 30 days as the maximum time a vehicle can be getting work during the new car warranty before it's deemed a lemon. Check out the New York law.

I had my i8 in service multiple times when I first got it.. ended up being in 6 of the 9 weeks I first had it. I went to bmw corp and was told they’d look in to compensation, contact regional and the GM.. never heard anything back. Tried talking direct to the GM and was told since corp was contacted, they will handle it. Contacted a lemon law lawyer only to find out they only take on cases that are super easy to win. Luckily I haven’t had any more issues since getting it back. I do miss my Porsche now due to the horrible customer relations I received from bmw.

I see you're in San Francisco. I'm not impressed with the Lemon Law lawyers you contacted based on what you've written.

Is that 30 days running or 30 days accumulative?

If accumulated/ wouldn't OP qualify for it in 2 days?

Cumulative.

Quote:
(a) This section shall be known and may be cited as the Tanner Consumer Protection Act.

(b) It shall be presumed that a reasonable number of attempts have been made to conform a new motor vehicle to the applicable express warranties if, within 18 months from delivery to the buyer or 18,000 miles on the odometer of the vehicle, whichever occurs first, one or more of the following occurs:

(1) The same nonconformity results in a condition that is likely to cause death or serious bodily injury if the vehicle is driven and the nonconformity has been subject to repair two or more times by the manufacturer or its agents, and the buyer or lessee has at least once directly notified the manufacturer of the need for the repair of the nonconformity.

(2) The same nonconformity has been subject to repair four or more times by the manufacturer or its agents and the buyer has at least once directly notified the manufacturer of the need for the repair of the nonconformity.

(3) The vehicle is out of service by reason of repair of nonconformities by the manufacturer or its agents for a cumulative total of more than 30 calendar days since delivery of the vehicle to the buyer. The 30-day limit shall be extended only if repairs cannot be performed due to conditions beyond the control of the manufacturer or its agents. The buyer shall be required to directly notify the manufacturer pursuant to paragraphs (1) and (2) only if the manufacturer has clearly and conspicuously disclosed to the buyer, with the warranty or the owner’s manual, the provisions of this section and that of subdivision (d) of Section 1793.2, including the requirement that the buyer must notify the manufacturer directly pursuant to paragraphs (1) and (2). The notification, if required, shall be sent to the address, if any, specified clearly and conspicuously by the manufacturer in the warranty or owner’s manual. This presumption shall be a rebuttable presumption affecting the burden of proof, and it may be asserted by the buyer in any civil action, including an action in small claims court, or other formal or informal proceeding.

I had the same issue and my car spent close to 8 weeks (cumulative) at the service. I got a brand new 7 series as a loaner plus the manager requested and got 2.5 months of my payment paid back with a cheque (and asked me if I can not make any negative statements on online reviews). So I'd say that they compensated fairly. If you have a good relationship with the manager, go to him, not BMW FS.

I am officially frustrated. Tomorrow starts week 4 that my i8 has been in the service department. A part from Germany was supposed ot arrive Friday and now they are telling me that the wrong part was sent and arrived and the correct one should arrive hopefully this week. That's 4th week already that I am stuck in a 3 series loaner meanwhile my monthly i8 payment is $1,460. If BMW does not offer some sort of compensation for this I will be irate.

Today starts week 4. So by next week the lemon law goes into effect?
Theyve been waiting on some back ordered part from Germany for weeks now. Today they told me it should be here this week but they said the same thing the last 2 weeks.

I wouldnt want to get rid of the i8 though as I love it however I had this drivetrain malfunction and regenerative breaking issue last october 2016 and they had the car for over 2 weeks and refused downtime compensation.

In California you can often get a replacement vehicle. Usually a step up in model year or mileage over what you have now. And the threat of Lemoning the car somrtimes wakes up sleepy and disinterested people at BMWUSA.

Man that really sucks ass. Sorry to hear what you're going through. I would have been irate a long time ago...but in the end it's so damn frustrating because what can you really do?

A friend of mine never got his brand new 335 off the lot, but had signed the lease papers. The car wouldn't start, and it took BMW over a month to get his car working. No compensation. There's a big report on it in the 335 forum. I think he did manage to at least get the ball rolling a little faster once the whole lemon report came into play. I know the 335 is a far cry from the i8, but they still fumbled over and over again with his car.

BMW can really really suck with customer service.

Keep us up to date man...may the force be with you!

Come to Rally BMW on Long Island. I always get 6 or 7 series as a loaner.
When my computer was damaged during the typical download I got a full bag of stuff. Hats, jackets, shirts, I8 bag, umbrella and 10 other things. Crazy!!
I love these guys.

I am fortunate enough to always get an i8 loaner whenever my car goes in. Likewise they gave me a bunch of free stuff when I took it in last year to have my display key fitted... In passing I just mentioned that the drivetrain error had appeared once and out came the goodies as an apology!

Crap, when something goes wrong with my M4 (or went wrong with my i8), especially when dealer-caused, I would have to fight for an appointment in the next 10 days and a loaner beater. No free stuff. No apologies for dealer screw ups. No nothing.

I guess that's why Bob Smith BMW is no longer in the Circle of Excellence, or whatever it's called now.

Question What if.....

Annoying that your car is in the garage for so long....

...but imagine if your i8 is in the garage for a week and you get a text from a neighbour saying they saw it driving around with someone else behind the wheel & you then track it to discover a technician has taken it home 30 miles away for the night for "an extended test drive"?

Well, that just happened to me today

I will give the (official) BMW i dealership a chance to explain themselves... otherwise I will share the full sorry tale, along with their name.

Oh boy, another JasH thriller in the making. Glad your self-authoring the story and not leaving it to Clarkson . Hope it has a happy ending.
