Update- after some frustration with the possessed e-drive/ICE randomness, the conclusion is that the issue is not with the Hybrid drive but with the ICE interface. I am now waiting for a new IME to arrive from Germany. Key take away is that when the car does different things under the same situation, something could be wrong. I was locked out of throttle control on a warm day, ICE fully warmed from running up a long hill and in comfort mode using about 10% power. E-Drive went away and the ICE wasn't running or available until Sport engaged.
