can become a factor in the investigation. i suspect what you're witnessing in the video is the beginnings of an investigation, and it starts with observation. they're watching him walk around (without his hands in handcuffs) unrestricted observing his unsteady gait. they are talking to him, listening to his slurred speech, and looking at his bloodshot, red, watery eyes. they may just even catch a whiff of an alcoholic beverage emitting from his breath and person.
