Drivetrain malfunction on i4

I took delivery of an i4edrive35 in April 2023. In early February, the yellow wrench came on and then a day later the red wrench warning to stop driving came on, and the car was towed to the BMW dealer. The vehicle has been at the dealer for 5 weeks for removal of metal debris from the electric motor housing. If the removal doesn't work, BMW will replace the motor which will take another month or so. Is this problem unusual?

I don’t understand why the car needs to be at the dealer for 5 weeks. The job takes all of about 12 hours.

Why taking so long....

Dealer says that they lack enough garage space dedicated for working on EV motors, so the car sat for 4 weeks waiting for a space to open up. The dealer is the largest BMW EV seller in California and perhaps US - Steven Creek BMW.

considering how long its been isn't grounds for getting a brand new car due to the lemon law? In NY if its down for 30 days for the same issue i would bring it up the lemon law to the dealer and they are prompt with getting the process going for a new replacement car.
