I can't get on board with the petition law. Too many jilted people out there who wouldn't give a second thought about wasting police time and possibly infringing on someones rights just because they are pissed. And as posed previously, what if your kid or wife is pissed at you, they call fictitiously, cops search your home, find your weapons. What then?

I feel that you as an American made a mistake here...a serious flaw which deeply concerns me. I've bolded it for your reading pleasure.

What you should have said was

They are firearms. They only become weapons when used that way.

Soooo....you view them as weapons do you??? Surrender them immediately you law-breaking criminal.

Pardon my ignorance here, but if the gov is the entity which issues permits to carry, then they certainly can ensure the people who receive such permits are at least educated prior to receiving the permit.

"Civilized", well that's a subjective thing that's hard to nail down, but educated, that is certainly within reasonable grasp as part of the process. Sit thru some lecture about how it's a really dumb idea to leave your gun loose in a purse, be tested on what bad things can happen if do so. Dont pass the test, dont get a concealed permit.

Obviously it still wont guarantee zero issues like this in the future, but it's still better than nothing... isn't it ??

She had to go through a class like you're describing in order to obtain a concealed carry permit. So did i. Unlike my high school Spanish classes, i actually absorbed the information i was subjected to during my concealed carry class. I can't say the same for everyone.

My statement you quoted was more along the lines not being able to make a horse drink after leading it to water.

I think if the judge agrees, and PD finds weapons, they are impounded. Not sure if the owner is taken in

As to jilted people, the judge will typically issue some contempt if you waste his time with trivial snide complaints

The guy in Santa Barbara the cops came by but didn't go into his house to search his room

So you think a judge will have to be involved in order to allow police to show up and search? Or would it be more like a domestic violence call where they show up and the call itself is probable cause?

Yeah, apparently if they would have gone in they would have not only found his weapons, but his manifesto was also in plain sight. But if i recall, the police said that they didn't search because the kid seem well rounded and not unstable during their interview. In addition, this was a police wellness check requested by the parents' attorney.

IIRC, a judge still has to see and grant the approval to search/remove the weapons. The evidence presented is designed to be enough to get past the well-rounded person answering the door.
