I am considering buying one but that's a feature I really want and if it can't be upgraded, it might be a deal killer for me.

BTW-I causally asked my sales rep locally and he said it will likely be upgraded as it was a problem BMW needs to solve for other models too. But, I was not 100% sold he is accurate.
The other way around, iX's that were built from March - June will be getting 8.5 by OTA (or dealer update if there is a related warranty repair or a nice dealer) starting in September.

It’s actually available now at some dealers. Just give them an excuse have you have CarPlay issues. That way it’s covered under warranty/maintenance.

Thanks, but what about a 2023 that was build lets say last year in Nov?

Negative. This has been covered about two dozen times on this same thread. Only vehicles built March 2023 onward which corresponds with a new head unit that was changed at the same time.

Yes, it has been available since last month. Unfortunately most dealers are not falling for the CarPlay problems anymore. I think the warning from BNMWNA sort of scared them off. We have had some folks get a goodwill update but most so far have been denied. A number of folks even are having a recall done on their X5/X7 and the dealer will still not update it.

Given the problems folks have been experiencing with 8.5 it probably is best to wait anyways.

This is where tipping your service advisor and their manager pays off. I always take care of my dealership for instances just like this. When I traded in my M550 in January, they reloaded iDrive 6 to the latest rev at no charge even though I wasn’t buying the iX from them.

Yes, it does wonders when you have a good relationship with them as well as the shop foreman, he has taken care of me with updates and no labor charges a number of times.

It’s worth every penny. I gave some Astros or Texans tickets to my service advisor at a Chevrolet dealership about 20 years ago. He was really taken back at the gesture and I’m still friends with him to this day. A little bit goes a long way when you make someone feel appreciated.

It's possible the new OS and features have more to do with model year than they do with hardware.

Can confirm, I just picked up my car from service for the sunroof repair, I requested the update but the invoice stated "not affected", the service advisor called his tech for details, and he was told only if the repair required programming, then they would perform the update to 8.5. Otherwise wait for the RSU that's due in September.

So there has been talk of some late 2023's with HU5. What qualifies a late build 2023? Are there really late build 2023s with HU5?

Yes. If the vehicle was produced in March 2023, it probably has it. It’s not specific to model year because that’s not how BMW does things when they make changes, it’s done by the start of the month and not by model year itself. There were some 2023 builds in March 2023 despite the 2024 changeover.
