Actually GM chimed in around January and said they will take action for dealerships that "damage the brand" and/or " damage the customer experience".

Things like marking up reserved cars in violation of program rules, marking up ordered EVs, transferring inventory to brokers for markup, etc are considered damaging to the brand.

They threaten reallocation of dealer vehicles and "other recourse prescribed by the Dealer Sales and Service Agreement."

It’s also the law of dealerships in the US (and the individual states). I wonder… I think dealership law is state-by-state, so I wonder how a call from a state legislator’s office would impact them…

Since dealerships are individually owned, i dont think BMW is going to do anything. They might take a dealer complaint but one complaint isnt going to make or break the dealer. Its going to be a collective effort to launch multiple complaints and bring down the dealer rating which will then affect the dealers standing with BMW and lower their allocation. I guess, 20K is a huge mark up but nothing like a 50K Market Adjustment my local dealership had for a M4 Kith edition. Retailed $120K and with market adjustment it was $170K. I guess, the M4 CSL might be cheaper

Some of the dealerships not marking up msrp are finding other ways to charge customers. My dealer had resistall as a 2k add on. I had to threaten to go to another dealer in order to have it removed from my deal. My expectation is after waiting a year they will try to add it back in the formal paperwork.

Check out passport BMW in MD. I live in Woodbrige VA and I know for sure that they don't do mark ups. Just bought my X6 M50 from them a couple weeks ago.

Every action had a counter reaction. There isn't any need to spend even one minute considering deals over MSRP. Take over a lease and wait until the law of supply and demand turns the pricing in your favor.
