So Where's the sweet spot ? 15 over ?

Yes we do! The speed surveys use the percentile rule and set speed limits based on the findings.

On the topic of speed limits, is there truth in a driver being potentially charged and arrested for going over the posted limit by a specific amount as a felony offense?

I'm pretty sure that 25 MPH over in NY State comes with an automatic reckless driving charge and handcuffs.

Back in the 1990's, I know first-hand that a certain southwestern state had a similar law. The nice officer dropped an 82 MPH in a 55 MPH zone down to 72 MPH, because we were running late to a charity/public awareness press appearance and he didn't want to cuff our driver and impound the car. Even so, the ticket included a significant state "brain injury" fine for being 15+ over.....

The Highway Traffic Act Stunt Driving section, 50KMH (30MPH) over the limit get's your car impounded for 14 days, a 30 day suspension of your licence and a $2K - $10K fine. These things get handed out like candy here it seems. In order to get charged criminally there has to be other elements, speed alone isn't considered Dangerous Driving a criminal offence.

If convicted there is the possibility for up to 30 days in jail, but I don't think anyone has ever been sent to jail for this offence, also at court you can have your licence suspended for an additional year besides the automatic road side suspension.

And they just ammended this law so that if you are 40KMH over the limit in a speed zone below 80KMH you will be charged.

It's similar here as well. I'm taking the car and recommending for suspension in some cases. The guy cruising along the 15 freeway to Vegas at 100 mph is different than the guy weaving in between cars and traversing multiple lanes at 100 mph.

There is always that. I always exercised my discretion, some folks make mistakes and the fines might be the family groceries for the week so I always tried to treat people fairly who deserved a break. But you're right, there are lots of ass hats out there who need the big stick. I miss dealing with those folks.

I remember 20 years ago I was driving from San Jose to Phoenix middle of the night. I hit CA-AZ border at midnight and pulled onto the highway after a quick stop along the border town for gas. I spot a semi flying along so what the heck - I figure if there is a cop shooting radar he will get it before I do and tailed the semi. I mean - 18 wheeler danger versus Mercedes sedan?

I got the cruise control set to 100 and didn't touch the gas or brake for over an hour. I didn't know those things could go that fast. Yowzah.

Yeah...I know...I brought this up to a friend who is also an officer and how I wasn't a huge fan of the new 40 km/h over law.

He naturally asked if I felt I needed to do 40 over in a 60 or less.

Soooo....no...I don't *need* to. But there are times and places is my point. If I'm in town or in a neighbourhood / school zone, no, and actually I try very hard to do less than 10 over at most in these cases.

But there are far too many side roads in Ontario that are (IMO) improperly marked at 60, when they should be 80. And I'm ok with the 50kmh over rule (more or less), but the 40km/h law bugs me for some reason. I think it is just because I suspect it will get progressively tighter, instead of doing anything at all about making licensing harder.

I don't disagree with your view on our speed limits. Hwy 401 is a great example, originally built in the 1960's with a speed limit of 70MPH, the road has been improved as have cars suspension, tires and breaking and yet the speed limit is now lowered to 100KHM (62MPH), the speed limit should be at least 120KPH.

I was stopped doing over 30mph in NY a few years ago. Officer told me that normally he would handcuff and put me in jail, but since I'm from IL he's going to write a ticket.
I didn't want that moving violation in my record, so started looking for lawyers, etc. in the area, but no one sounded promising, so decided I'll send it to court and try my luck.
Luckily I got a mail a few weeks later, stating that I don't have to show up for court, but instead was offered to pay 2 parking tickets = 200$.
Lucky me I guess, but lesson learned.
