A few questions

1. If the car gets lemoned do i receive all payments and down payment back including taxes?

2. Do i have to pay the lawyer fees or if the case is won bmw pays the lawyer fees

3. Any recommendations on lemon law lawyers in nyc?

What is the basis of why you are trying to lemon law your vehicle?

1. NO
2. U PAY LAWYER
3. NEGATIVE CONTACT BMW NA if in fact your car is a lemon it has to be noted in there system that the problem is there and has not been fixed more than 3 times!!

BMW already said it was a lemon

What do i get back just my downpayment?

So basically your saying i need to pay for my own lawyer to get out of a car that is broken and then get nothing back for what doesn't make too much sense too me

Typically BMW will buy back the vehicle before it is considered a Lemon, that is why i'm asking.

Rarely does it get to the point where the lemon law is used in court for BMW, there are lawyers out there that will fight for you, however im unsure if you get reimbursed.

I know of one person that settled with keeping the vehicle, however they paid the rest of the lease off. The best option would to contact a lawyer who specializes in this area.

OK they offered me a new 335 and as a customer do not want another 335 due to the problems i experienced with this car. Yes i loved the car yes i would buy another one but at this point and time in my life i do not want another 335. I wanted a m3 and they could not get that done so then we tried another route. They also could not get that done. So now as a customer do I not have the choice to be out of my car due to it being a lemon? I feel i do. I may be wrong but i feel im right. Honestly I do not want to go threw this whole process but if BMW cannot make me happy without it then i have no choice. I tried working with them and after a few attempts at vehicle choices i was not pleased. I am not asking for deals or discounts just get me out of my lemon 335 and get me into a m3 or anything else i choose with a new contract. They seem to not understand that. We shall see but my questions still haven't been answered thank you guys for your concerns.

I do understand your point of view as being a customer of bmw myself more than a couple of times!!
I wanna be made happy and feal like a valued customer thats for sure..
It looks what there willing to do is replace the car with a take it or leave it type of deal!! U have to realize teh M3 is a step up so more money/% rates probably are nothing compared to the 335 so there not budging at all..
U should just be more adamite on what u want and dont let down!!!

If you want advice on the lemon law, go to a lawyer that specializes in your state's lemon law and lemon laws in general. In litigation, typically lawyers will not charge you for the initial consultation. If BMW is making you a deal, or your dealer is trying to offer you a deal, work with them to see what can be done. However, do not expect them to bend over backwards for you. They are limited in what they can do, or are authorized to do, to make this right. Also remember, just because someone at the dealer calls your car a lemon, does not mean your car is actually a lemon under the legal definition. And just because they offered to trade you a new 335 does not mean they would be willing to offer you an M3, they could have already sold all their allotted M3's and not be able to get anymore. So again, talk to the people at BMW, and if you are unsatisfied, talk to a lawyer. But take nothing for granted.
